Portugal Rejects Claims of Incompatibility Between CPLP Visas and Schengen Regime
In response to the infringement procedure launched by the EU Commission against Portugal, Secretary Antunes said that the country will continue to apply the CPLP mobility regime, meaning that CPLP citizens will continue to be subject to facilitated rules when applying for a visa.
The same authority said that Portugal is surprised by the decision of the EU Commission to open an infringement procedure as there is no incompatibility between the two regimes, AtoZSerwisPlus.pt reports.
As Publico explains, Secretary Antunes further highlighted that the country would not have adopted facilitated rules if they thought they were not in line with the Schengen regime.
In addition, he assured everyone that Portugal will continue to apply the CPLP mobility regime “within a framework of total legality.”
CPLP immigrants in Portugal previously complained over mobility restrictions, saying that despite being subject to facilitated visa application rules, the document does not permit them to travel outside Portugal.
Calling Portugal an open-air prison for those who arrive on a CPLP visa, Timóteo Macedo, from the Association for the Defense of Immigrants’ Rights, said that freedom of movement does not exist. The same called on the authorities to take measures on the matter.
On the other hand, Secretary Antunes said that there is no such thing as incompatibility, emphasising that the doubts raised by the Commission are based on the complaints made by an individual who has already received a clarification from the authorities.
Following complaints, the EU Commission considered that Portugal does not comply with the EU obligations that establish a uniform model of residence permits for third-country nationals and with the Schengen agreement on free movement, Publico notes.
The President of Portugal, Marcelo Rebelo de Sousa, has also rejected the incompatibility between the Portuguese and European visa regimes.
He said that the country has already explained several times that there is no clash between the two regimes.
In contrast, the Chega parliamentary group said that it would submit a request to the Parliament to revoke the CPLP mobility agreement, saying that this was “always nonsense and deception.”
